When a stepparent has become a child’s real everyday parent, Virginia law offers a path to make it legal – conferring full parental rights, inheritance, and the permanence families crave. Here is how it works in the Roanoke Valley.
The Central Issue: The Other Birth Parent
Adoption ends the legal parenthood of the birth parent being replaced, so their consent is the heart of the case. Three paths:
- Consent: the smoothest route – the birth parent voluntarily agrees, often when they have long been absent and welcome resolution of support obligations going forward.
- Consent withheld contrary to the child’s best interests: Virginia courts can approve the adoption over objection when the evidence shows the objection defeats the child’s welfare.
- Abandonment: where a birth parent has failed, without just cause, to visit or contact the child for six months, courts may find consent unnecessary.
Contested cases are genuine litigation – a birth parent’s rights receive strong constitutional protection, and the record of absence, non-support, and the stepparent’s role must be built carefully.
The Process
Stepparent adoptions are filed in circuit court – Roanoke City, Salem, or Roanoke County depending on residence. Virginia streamlines these cases: the home study required in agency adoptions is typically waived or simplified, and where consents are in order, many families complete the process in a few months, capped by a final order (and, if wished, a new birth certificate).
What Changes Legally
The adopting stepparent becomes the child’s parent for every purpose: custody and decision-making, support obligation, inheritance, insurance and benefits. The displaced parent’s future support obligation ends – though arrears already owed survive. If the marriage later ends, the adoptive parent stands as a full parent in any custody case.
Timing and Care
