Virginia does not require you to hire a lawyer for a custody or visitation case. Parents can and do file their own petitions in the Juvenile and Domestic Relations District Courts serving Roanoke and Salem. Whether you should go without one is a different question.
When Handling It Yourself May Be Reasonable
If you and the other parent genuinely agree on a schedule, communicate well, and simply need your agreement turned into a court order, the process can be straightforward. Even then, a single consultation before you sign can catch problems with holidays, travel, decision-making, and child support that are hard to fix later.
When You Should Have Counsel
- The other parent has hired a lawyer.
- There are allegations of abuse, neglect, substance use, or unsafe conditions.
- One parent plans to relocate with the child.
- A guardian ad litem has been appointed.
- Another state or an older court order is involved.
- You and the other parent disagree about where the child should primarily live.
Why the Stakes Are Higher Than They Look
A custody order is not easy to undo. To change it later, a parent generally has to show a material change in circumstances and that the change serves the child’s best interests. The order you get the first time often shapes the next several years. Our guide to modifying a custody order in Roanoke explains that standard.
What Court Is Actually Like
Custody hearings follow the rules of evidence. The judge cannot give you legal advice or help you present your case, and the other side’s lawyer can object to testimony and documents you assumed would come in. If you are unhappy with a final J&DR order, you may appeal to circuit court for a new trial, but the deadline to note that appeal is short – ten days.
A Practical Middle Ground
If cost is the concern, start with a consultation. An hour with an experienced custody lawyer will tell you how strong your position is, what evidence you need, and whether your case is one you can reasonably handle alone.
