More than a third of Virginia children are born to unmarried parents, and the custody questions those families bring us are some of the most urgent we see. The good news: Virginia custody law treats unmarried parents by the same best-interests standard as divorcing ones. The catch: unmarried fathers in particular need to take affirmative legal steps before their rights are secure.
Start With Paternity
For unmarried parents, everything runs through legal paternity. Signing a voluntary Acknowledgment of Paternity at the hospital, being named through a paternity proceeding, or DNA testing ordered by the court all establish it. Until paternity is legally established, a father has no enforceable custody or visitation rights – and a mother cannot obtain a child support order against him.
A Birth Certificate Is Not Custody
A common misunderstanding: being on the birth certificate does not by itself create an enforceable custody schedule. Without a court order, neither unmarried parent has defined rights the police or courts will enforce – which becomes a crisis the first time one parent refuses to return the child. The fix is a custody and visitation order from the juvenile and domestic relations district court – in our area, the Roanoke City J&DR Court or the courts serving Salem and Roanoke County.
What the Court Will Order
Once paternity is established and a petition is filed, the court applies Virginia’s best-interests factors exactly as in a divorce case: caretaking history, stability, cooperation between parents, any history of abuse. Unmarried fathers who have been hands-on parents win meaningful custody and visitation every day in Virginia courts.
Do It Before There Is a Crisis
The best time to get a custody order is while things are amicable – it is faster, cheaper, and calmer. The worst time is after a breakup turns hostile and a child becomes leverage. If you are an unmarried parent in the Roanoke Valley without an order, that should be at the top of your list.
