A support order is only as good as its enforcement. When payments stop, Virginia gives custodial parents real teeth – and gives non-paying parents very little room to hide. Here is how enforcement works for families in Roanoke and Salem.
The Enforcement Toolbox
- Income withholding: support deducted directly from wages – the default for most orders, and extendable to new employers
- Contempt of court: a show-cause proceeding in J&DR court where the non-payer must explain the failure; consequences run from payment plans to jail time with a purge amount
- License suspension: driver’s and occupational licenses can be suspended for substantial arrears
- Tax refund interception, liens, and credit reporting
- Interest: arrears accrue judgment interest, and unpaid support in Virginia cannot be retroactively forgiven – the debt does not age off
DCSE or Private Counsel?
Virginia’s Division of Child Support Enforcement handles collection at no charge, and for straightforward wage-earner cases it works well. Private enforcement through counsel tends to move faster and digs deeper when the non-paying parent is self-employed, paid in cash, or hiding income – situations where subpoenas for bank records and pointed cross-examination in a contempt hearing change behavior quickly.
If You Are the Parent Who Cannot Pay
Do not simply stop paying and hope. Arrears at the full ordered rate are accruing, with interest, and contempt exposure grows monthly. The correct move is a modification petition filed immediately – courts can only adjust support back to the filing date – paired with paying what you genuinely can in the meantime. Judges treat documented effort very differently from silence.
One Thing Never to Do
Support and visitation are separate obligations. Withholding the children over unpaid support – or withholding payment over blocked visits – violates the orders and hands the other side the moral and legal high ground. Enforce each order through the court, not through self-help.
