The Three Levels of Protection
- Emergency protective order (EPO): issued any hour of the day, typically after police respond to an incident, by a magistrate. It lasts about seventy-two hours – a bridge to the next step.
- Preliminary protective order (PPO): obtained by filing a petition with the juvenile and domestic relations court – in Roanoke, the J&DR intake office at the courts complex; in Salem, the courts serving the city and Roanoke County. A judge can issue it the same day based on your sworn petition, and it lasts up to fifteen days until a full hearing.
- Final protective order: after a hearing where both sides appear and present evidence, a judge may enter protection lasting up to two years, renewable.
What an Order Can Do
Beyond ordering no contact, Virginia protective orders can grant you temporary possession of the residence, temporary custody of children, use of a vehicle, and require the respondent to surrender firearms. Violating a protective order is a criminal offense with mandatory arrest policies – these orders have teeth.
What You Must Show
Family abuse protective orders require proof of an act of violence, force, or threat that placed you in reasonable fear of harm, committed by a family or household member.
